Terms and Conditions of Services
These Terms and Conditions govern all charter, hire and passenger transport services supplied by iBus Hire (“iBus Hire”, “we”, “us”, “our”). By confirming a booking, paying a deposit, making full payment, or using our services, the Hirer and all passengers (“you”, “your”) agree to be bound by these Terms and Conditions.
iBus Hire operates in accordance with all applicable laws, including but not limited to the Passenger Transport Act 2014 (NSW), Passenger Transport Regulation 2017 (NSW), Transport for NSW requirements, and all NSW road safety legislation.
iBus Hire may amend these Terms and Conditions at any time. The most current version is published on our website.
- Passenger Conduct and Safety
1.1 The driver retains full authority and responsibility for the safe operation of the vehicle at all times.
1.2 The Hirer is responsible for the behaviour of all passengers and will be liable for any loss, damage, cleaning costs, or additional expenses arising from passenger conduct.
1.3 Smoking, vaping and the use of e-cigarettes are strictly prohibited inside all vehicles under NSW law. Smoking outside the vehicle must occur no less than four (4) metres away.
1.4 The driver may refuse carriage to any passenger who is intoxicated, abusive, aggressive, or poses a safety or operational risk.
1.5 iBus Hire may immediately terminate the service if passengers engage in unlawful, unsafe or disruptive behaviour. No refund is payable, and iBus Hire accepts no liability for any resulting inconvenience, cost or loss.
1.6 Passengers must not tamper with or interfere with any vehicle equipment or fittings.
1.7 The Hirer must inspect the vehicle before departure and raise any concerns with the driver at that time.
- Food, Beverages and Cleanliness
2.1 Consumption of food and drink onboard is prohibited, with the exception of bottled water, in accordance with NSW legislation unless medically required.
2.2 Passengers must remain seated with seatbelts fastened while the vehicle is in motion. No body parts or personal items may be extended outside the vehicle.
2.3 All rubbish must be removed by passengers. A minimum cleaning fee of $88 (incl. GST) will apply if the vehicle is left in an unreasonable condition.
2.4 The Hirer is liable for all additional cleaning, repair costs, fines, penalties or related expenses arising from passenger actions.
- Alcohol
3.1 Consumption of alcohol onboard any vehicle is strictly prohibited.
3.2 iBus Hire does not provide party bus services under any circumstances.
3.3 Unopened alcohol must not be carried onboard without prior written approval. Approved alcohol must be stored securely by the driver.
- Additional Charges and Itinerary Variations
4.1 Changes to the itinerary, route, duration or kilometres travelled may incur additional charges. Tolls, parking fees and entry charges are not included unless expressly stated.
4.2 Any additional or unexpected costs incurred during the charter, including waiting time, fines or cleaning, are payable by the Hirer.
4.3 The Hirer must nominate a safe and legal pickup location. Fines incurred due to unsafe or unlawful stopping points may be passed on to the Hirer.
4.4 A 15-minute grace period applies from the scheduled pickup time. After this period, waiting time will be charged from the original scheduled pickup time.
4.5 Waiting time charges:
- Minibuses: $30 per 15 minutes
- Coaches: $50 per 15 minutes
4.6 iBus Hire may deduct charges for damages, cleaning, waiting time, fines or other recoverable costs from the Hirer’s credit card or security bond.
4.7 The Hirer accepts full responsibility for passenger behaviour and any fines arising from misconduct.
- Cancellations, Charges and Refunds
5.1 If the vehicle has departed the depot and the service is not utilised, the booking is deemed a non-cancelled service and full charges apply.
5.2 If the Hirer fails to present within forty-five (45) minutes of the scheduled pickup time, the service will be terminated and treated as a non-cancelled service.
5.3 Failure to make payment prior to service (where required) constitutes a non-cancelled service.
5.4 Cancellations must be submitted in writing via email. Failure to pay does not constitute cancellation.
5.5 Cancellation fees:
- Within 48 hours: 100%
- 3 days prior: 70%
- 4 days prior: 50%
- 5 days prior: 35%
- 6 days prior: 20%
- 7 days prior: 10% or forfeited deposit (whichever is greater)
5.6 In the event of mechanical failure, iBus Hire will refund only the unused portion of the charter fee. No compensation is payable for consequential loss, including missed events, accommodation or tours.
5.7 The Hirer is liable for all third-party supplier costs associated with any cancelled booking.
- Tentative Bookings
6.1 Tentative bookings are held for three (3) days.
6.2 A tentative booking becomes confirmed only upon payment of a non-refundable 20% deposit.
- Quotes
7.1 All quotes are valid for fourteen (14) days.
7.2 Quotes may be revised if the Hirer alters the itinerary, route, passenger numbers or service requirements.
- Payments
8.1 Bookings made more than seven (7) days before service require a 20% non-refundable deposit unless agreed otherwise in writing.
8.2 Full payment is required at least seven (7) days prior to the service unless otherwise agreed.
8.3 Bookings made within seven (7) days of service must be paid in full at the time of booking.
8.4 Failure to make payment by the due date may result in cancellation, treated as a non-cancelled service.
8.5 Late payments may incur compound interest of 10% per calendar month.
8.6 All debt-recovery costs (including agency and legal fees) are payable by the Hirer.
8.7 The Hirer remains personally liable for all amounts due.
8.8 Accepted payment methods include Visa, Mastercard, AMEX, JCB and EFT. All card payments are processed via the Square payment system. Cash and cheques are not accepted.
Security Bonds and Additional Payments
8.9 A security bond may be required for certain bookings.
8.10 The Hirer authorises iBus Hire to debit the nominated payment card for overtime, damages, fines, tolls, unpaid fees or other recoverable charges.
8.11 The Hirer agrees to pay all legal, administrative and collection costs incurred in recovering outstanding amounts.
- Breakdowns, Delays and Route Selection
9.1 All journey times are estimates only. Delays arising from traffic, weather, roadworks, accidents, special events or other circumstances beyond our control do not constitute grounds for cancellation or refund.
9.2 Delays do not entitle the Hirer to compensation.
9.3 Drivers may vary the route where necessary for safety, legal or operational reasons.
- Driver Hours and Fatigue Management
10.1 All drivers must comply with NSW fatigue-management, work-time and rest-break requirements. Maximum driving hours are prescribed by law and cannot be exceeded.
- Passenger Property and Lost Property
11.1 The driver has sole discretion to determine whether luggage can be safely carried.
11.2 All luggage is carried entirely at the owner’s risk. iBus Hire accepts no liability for loss or damage, including loss caused by negligence.
11.3 Lost property is retained for three (3) weeks before disposal.
- Vehicles, Equipment and Licensing
12.1 While vehicles are regularly inspected, iBus Hire may substitute a vehicle where required. Substituted vehicles may differ from those originally quoted.
12.2 Entertainment equipment (e.g., DVD systems) is not guaranteed and may vary with vehicle allocation.
12.3 Public performance of copyrighted material requires the appropriate licence.
12.4 Any screening licence must be supplied to iBus Hire at least forty-eight (48) hours prior to travel.
- General Conditions
13.1 iBus Hire may subcontract part or all of a service where necessary.
13.2 In an emergency, passengers must comply with all directions given by the driver.
13.3 The driver may adjust or modify the itinerary for safety, legal or operational requirements.
13.4 On-the-day variations are at the driver’s discretion.
13.5 By confirming a booking or paying a deposit, the Hirer accepts all Terms and Conditions.
- Overnight and Extended Charters
14.1 The Hirer must provide each driver with a private hotel room of at least 3-star standard.
14.2 iBus Hire may arrange accommodation on request, with costs invoiced to the Hirer.
14.3 Itinerary requirements:
- Draft itinerary: at least 1 week prior
- Final itinerary: at least 2 days prior
14.4 Drivers may be accommodated in alternative suitable accommodation when required.
14.5 A meal allowance of $66 per driver per day applies.
- Complaints
15.1 Complaints must be submitted in writing via email.
15.2 Complaints are recorded and managed in accordance with NSW Passenger Transport Regulations.
- Notices and Signage
16.1 Decorations, signs or promotional materials must not be affixed to any vehicle without prior written approval.
16.2 The Hirer is liable for costs associated with the installation or removal of approved signage.
- Governing Law
This agreement is governed by the laws of the State of New South Wales, Australia.
- Force Majeure
iBus Hire is not responsible for delays or failure to perform due to events beyond our reasonable control, including natural disasters, industrial action, accidents, government directives or other unforeseen circumstances.
- Limitation of Liability
19.1 iBus Hire is not liable for indirect, incidental, special or consequential loss, including loss of profit, opportunity or enjoyment.
19.2 Our maximum liability is limited to the charter fee paid for the affected day of service.
- Price Adjustments
Prices may vary where:
- fuel costs increase,
- legislative or regulatory changes impose additional costs,
- operating conditions change, or
- the final itinerary differs from the original quote.
- Prohibited Items
The following items are strictly prohibited onboard:
- Decorations
- Alcohol
- Smoking, vaping and e-cigarettes
- Glass containers
- Golf shoes or spiked footwear
- Fuel containers
- Generators
- Illegal substances
- Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior verbal or written agreements relating to the subject matter.
